Clarity, not legalese

The USPTO writes for lawyers.
You're not one.

If you filed your trademark yourself, you've probably seen messages like “Non-Final Action E-Mailed” or “Suspension Letter Issued,” with no explanation of what they mean. Some come with strict deadlines. Miss one, and your application can be abandoned, along with the filing fees you paid.

Most office actions give you 3 months to respond. The clock may already be running.

What the USPTO says vs. what we tell you.

Illustrative example · not your application

USPTO says

“NON-FINAL ACTION E-MAILED. Registration is refused because the applied-for mark merely describes a feature of applicant's goods. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1)…”

An official status. A lot of questions.

Trademark Watch says

What happened

The examining attorney refused your application, for now. They think your brand name simply describes what you sell. Descriptive names usually can't be registered on the main register.

Yes, you need to act. Without a response, your application will be abandoned.

Response deadline

January 14, 2027

3 months from the action date. One 3-month extension is available for a fee.

Your options

  • Argue that your mark is not descriptive.
  • Amend to the Supplemental Register, if eligible.
  • Let the application go and refile with a different name.

Complexity: Medium–High. A common point where people hire a trademark attorney.

What we are and what we're not.

We're not the USPTO

Trademark Watch is an independent service, not affiliated with or endorsed by the United States Patent and Trademark Office.

We're not a law firm

Our explanations are general information, not legal advice. For your specific situation, talk to a licensed attorney.

No payment demands

We never ask for payment to keep your trademark alive. Official USPTO fees are paid only through USPTO.gov.

Your data stays yours

We use public USPTO records and only the information you give us.

A few good questions.

Is this really free?

Yes. The free plan covers up to 10 trademarks, with no credit card. Trademark Watch is supported by listings from independent trademark attorneys. You're never required to hire anyone.

Where does your data come from?

Official, public USPTO Trademark Status & Document Retrieval (TSDR) records. Always confirm important dates and documents in your official USPTO records.

Do I need to create an account?

Not to preview your application. A free account lets you save your trademarks and see updates and reminders in your notification inbox. Email delivery is coming soon.

Will you file responses for me?

No. We explain what's happening and what your options are. If you need someone to file a response, you can hire a licensed trademark attorney of your choice.

Is the explanation legal advice?

No. It's general information to help you understand your application. Every case is different. Consult a licensed attorney for advice about your specific situation.

What if I miss a deadline?

In some cases, you can petition to revive an abandoned application, usually within two months of the notice of abandonment. Eligibility and timing depend on your case; talk to a trademark attorney promptly.
